RESOLUTION NO. 3426

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOLEDAD MAKING MINOR CHANGES TO THE CITY OF SOLEDAD

CONFLICT OF INTEREST CODE

WHEREAS, the Political Reform Act, Government Code Sections 81000, et. seq., requires every State or local government agency to adopt and promulgate a Conflict of Interest Code; and

WHEREAS, the City of Soledad, by way of Resolution No. 2551, has previously adopted a Conflict of Interest Code incorporating restrictions and regulations set forth in 2. Cal. Code of Regulations, Sections 18109 et. seq., and City appendicies A and B, which have been modified periodically to add or delete the titles of City positions subject to various conflict laws; and

WHEREAS, the City Attorney has determined that Appendix A, which was last modified by Resolution No. 2654 in March of 1998, requires minor modification in order to reflect recent staffing changes in the City of Soledad.

NOW THEREFORE, BE IT HEREBY RESOLVED , that:

  • Appendix A of the City's Conflict Code is hereby amended, so as to add or modify existing job classification titles as follows: Finance/Personnel Officer, Community Development Director, Building Official, Chief of Police, Public Works Director/City Engineer and Economic Development Director. The following positions will be deleted: Finance Director and Planning Director. Amended Appendix A, a copy of which is attached hereto as "Exhibit A", shall replace and supersede previous Appendix A.
  • All persons holding designated positions identified in Amended Appendix A shall file statements of economic interest pursuant to the Conflict of Interest Code.
  • With the exception of the proposed modifications referenced above, all other provisions of the Conflict of Interest Code adopted by Resolution No. 2551 shall remain in full force and effect.
  • The City Clerk is hereby authorized and directed to prepare and forward the Local Agency Biennial Notice reflecting the changes set forth above to the Fair Political Practices Commission.

PASSED AND ADOPTED by the City Council of the City of Soledad at a regular meeting dully held on the 3 rd day of March, 2004, by the following vote:

* The definition of "Consultant" contained in 2 Cal. Code of Regs., Section 18700 18701 (a)(2), and any amendment to said section duly adopted by the Fair Political Practices Commission, is incorporation herein by reference.

With respect to Consultants, the City Manager may determine in writing that a particular consultant is hired to perform a range of duties that are limited in scope and thus not required to comply with the disclosure requirements described in these categories. Such determination shall include a description of the consultant's duties, and, based upon that description, a statement of the extent of the disclosure requirements. The city manager shall forward a copy of this determination to the Fair Political Practices Commission. Nothing herein excuses any such consultant from any other provision of this Conflict of Interest Code.

** It has been determined that the positions listed below manage public investments and will file a statement of economic interests pursuant to Government Code Section 87200:
